Grievance Description:AIPRPA / Pre-2006 / 1 / 7/ 2017 Dated 17th July, 2017 To The Prime Minister Government of India New Delhi – 110001 Respected Sir, Sub: Request for reconsideration of the unjustified stand taken by the Department of Expenditure on the matter of extending the benefit of Court Judgment to all similarly placed Pre-2006 Pensioners – regarding. This All India Postal RMS Pensioners Association would desire to point out an irrational stand taken by the Ministry of Finance, Department of Expenditure despite recommendation to extend the benefit of Court Judgment to all similarly placed Pre-2006 Pensioners by the Department of Pension Pensioners Welfare. We place the following for your benign consideration and appropriate orders. There are many Court Judgments to fix the Pension of Pre-2006 Pensioners on the basis of the pay scale granted to their cadre by the 6th CPC or implemented by the Government to the serving employees of the same cadre. The judgments have been accepted and implemented in several cases by the Government only to the petitioners / litigants. As per the official minutes of the SCOVA meeting conducted by the Honourable Minister of State for Personnel, the Department of Pension Pensioners Welfare had written to the Department of Expenditure in favour of extending the benefit to all similarly placed Pre-2006 Pensioners in the background of Government implementing the Court Judgment in several cases of litigants. Unfortunately, the minutes informs that the recommendation of the Department of Pension had been rejected by the Department of Expenditure, which is unethical according to Supreme Court Judgment that directs the Government that such judgments should be invariably extended to all similarly placed candidates. This Association would further like to point out that because of the above adamant stand of the Department of Expenditure, the 12th July orders of DoPPW for Pension Refixation cases of Pre-2016 Pensioners also contain the same clause to refix the pension only on the basis of the replacement scales and not on the basis of the scale of pay implemented to the serving employees. To render justice it is paramount to grant all Pre-2006 and Pre-2016 Pensioners the benefit of Court Judgment for fixation of Pension in the pay scales implemented to the post or cadre instead of only on the replacement scales. This Association requests your kind intervention for appropriate reconsideration of the issue without formally approaching the issue only on financial consideration instead of ethical consideration. Details:It is policy decision of Ministry of Finance. There is no link to submit/ forward the complaint to them online hence it is closed. it is requested to lodge the complaint again on DARPG portal with request to forward the same to Ministry of Finance.
