Justice only if you fight!

Justice won through Court of law! But justice is still not in sight for GDS!

Congratulations to NFPE Unions on getting Government Recognition as 1st Unions!

Congratulations to all unions and associations of NFPE, FNPO and BPEF who won recognition as 1st or 2nd status!

Despite the verification conducted years ago, the NDA Government as a political move refused to grant recognition as perCCS (RSA) Rules, 1993 to winning Unions and Associations. This was a calculated move to favour its own preferred unions.

The Honourable Madras High Court intervened at the litigation of NFPE SBCO Association of Tamilnadu Circle. Only on the orders of Court, the Government relented and issued orders recognising eligible unions.

Here also, the cunningness of Government is visible. Earlier the stand of government was that such recognition will be valid for 5 years from date of issue of orders. But this time the order is dated currently but effect is given from 2015! Intention is to once again create problems as the next verification will be around the corner!

More over, the GDS unions are left out. May be it was under different set of Rules of ED (RA) Rules, 1995. But GDS being a big section and in fact outnumber regular employees, recognition to GDS unions under verification is more important. But, the Government takes shelter under technical grounds! May be a court case and another intervention may be needed for this Government to act on this matter!

Let us congratulate all unions and Associations won the recognition based on membership verification!

PRESIDENT:       COM.SHIV GOPAL MISHRA.(97176 47594)
SECY. GENERAL:          COM.K.K.N.KUTTY. (98110 483030

Dated:  12th July, 2019.

Kindly refer to the discussions and decisions we had taken at the NCCPA NE meeting on the last occasion.  We were to file cases before the Principal Bench of the Central Administrative Tribunal, New Delhi on the following issues:

On Option No 1.
MACP to be given effect to 1.01. 2006.

As per the advice of CGPA Kerala, we were to engage Shri Kaleeswaram Raj as our lawyer in the first case.  In the second one, we were to await the decision of the Government for some more time.  Shri Kaleeswaran Raj had indicated a consolidated sum of Rs.  2 lakhs of which we were to make the payment of Rs. 1 lakh on the day the case was to be handed over to him with vakalatnama. We had decided to collect funds for this purpose.  The CHQ had been asked to fix quota of funds for the affiliates and the COC.  We had written to all the affiliates and the CGPAs to intimate us of their membership to enable us to finalise the due statement as also to fix quota of funds for litigation purpose.  We are yet to receive reply to our communication from almost al affiliates and CGPA.

Without having the facility of the membership of the respective organsiations,  we now give hereunder the amount to be remitted by each affiliate and COCs

AIPRPA Rs.30,000
AIBDPA Rs. 30,000
ITPF Rs. 15,000
All India Audit & Accts. Pensioners Assn. Rs. 10,000
Cofees Board and autonomous orgn.  Rs. 10,000
CGPA  Kerala Rs. 20,000
CGPA  West Bengal Rs. 20,000
CGPA  Hyderabad Rs. 15,000
CGPA  Nagpur Rs. 10,000
CGPA Rajasthan Rs.   5,000
All  other affiliates and COCs. Rs. 2000 each.
The fund allocation will be reviewed on receipt of the membership details  As and when we receive the  amount  from the affiliates and CGPAs, the case wil be filed after contacting the lawyers, Shri Kaleeswaram Raj.

In the case of MACP, the matter came up for discussion at the 47th meting of the National Council, JCM.  The Cabinet Secretary said that the Supreme Court judgements would be made applicable for all similarly placed personnel.  The meeting was held on 13th April, 2019.  We received the draft minutes in May, 2019.  The above observation of the Chairman had been omitted   We took up the matter with the Govt.  Now the final minutes have been issued.   But they have incorporated the following two words to the observation of the Chairman.  i.e. “Judgements, which are relevant and possible”.  We have again written a letter to the Govt.  to further amend the minutes.  In the meantime, the staff side has again written to the Secretary Personnel to implement the judgements of the supreme court in the cases of all similarly placed personnel. We are not going to make an indefinite wait on the Government in this matter. Our decision was to collect the application from the individual pensioners along with Rs. 1000.   No steps seems to have taken by the affiliates and the State CoC.   Once the money received, we shall be able to file the case before the tribunal.

We await for your response,

With greetings,

Yours fraternally,
K.K.N. Kutty
Secretary General.

Pre-2006 Important order - But the struggle is not over!

Pre-2006 Pensioners in 6500-10500 scale or in equivalant scales prior to 5th CPC will get refixation of pension as per concordan!e table with GP 4600!
Pension Ministry order as under:
The Pension Ministry has released an order on 9th July, 2019 granting refixation of pension based on Grade Pay 4600 to those Pensioners of Pre-2006 in 6500-10500 scale or in the equivalanet scale of pay prior to that.
According to this order, all Pre-2006 HSG-1 Pensioners will get their pension refixed by giving the advantage of higher grade pay of 4600/- as per the concordance table annexed in that order.
This order does not solve our entire problem of Pre-2006 Pensioners including the HSG-1. The order only grants the advantage of Grade Pay 4600 and not the upgraded scales of pay if any granted to any post or cadre from which the Pre-2006 Pensioners had retired. Anyway, the order dated 9.7.2019 grants the refixation based on GP 4600/- to HSG-1 Postmasters retired prior to 1.1.2006:
The order is as follows: (If the order is not clear and anyone desires a original copy may visit the pensioners ministry website in www.doppw.gov.in and download a copy)
