Greetings of May Day

AIPRPA CHQ's MAY DAY GREETINGS 




May Day this year as always inspires all the workers and toiling people. The supreme sacrifices of leaders of May Day movement who were hanged to death by the US Government and the US Judiciary as well as many workers who sacrificed their lives to the brutal police firing in Hay Market Square in Chicago City formed the foundation of a strong working class movement all over the world. Let us salute those Martyres on this year May Day also.

The May Day this year comes in the wake of a larger unity of Indian Working Class against the intensification of the attacks by the Central Government in the form of attempted laws to snatch all the existing labour welfare laws and trade union rights. This May Day also unfolds with a clarion call by the Postal Joint Council of Action for an indefinite strike from May 6th against the retrograde recommendations of the Task Force headed by former Cabinet Secretary TSR Subramanian appointed by the Prime Minister to open the path for quick privatisation of Indian Postal Department. The Strike is also for seeking justice to Gramin Dak Sewaks so that they are included into the ambit of the 7th CPC. 

Let all the members of the AIPRPA befittingly hold May Day Programmes besides extending total solidarity to the striking Postal Employees through holding demonstrations during the indefinite strike.

Another Mile Stone Judgment in favour of Pre-2006 Pensioners

20 years’ Service enough for full pension 

even for  Pre-2006 Pensioners

Outcome of Supreme Court Judgment on this issue





Apex Court dismissed SLP No.C…/2014 CC No (s) , 20144/2014 on 20-02-2015. This SLP was arising out of final judgment of Kerala High Court at Ernakulam dated 07.01.2014 in OPCAT No.8/2014 viz., Union of India vs M.O.Inasu.

The Kerala High Court judgment under question was a judgment of Ernakulam Bench of CAT filed by Mr.M.O.Inasu and Mr.K.Ramachandran Unnithan made on re-hearing as directed by the Kerala High Court that ordered to implement the  6th CPC recommendation of reducing the required 33 years of service into 20 years’  for grant of full qualifying pension of 50% of LPD or 10 months average whichever is greater to Pre-2006 Pensioners.

Kerala Comrades have supplied the judgment of CAT Ernakulam Bench viz., OA No.715 of 2012 with OA No.1051 of 2012. The OA No.715 of 2012 pertains to the case filed by Mr.M.O.Inasu  and the OA No.1051 of 2012 pertains to the case filed by Mr. K.Ramachandran Unnithan . Both of them were retired Deputy office Superintendent in Excise Department. The above referred Kerala High Court judgment and the dismissal of SLP by the Apex Court have come as final outcome of both of their OAs in Ernakulam Bench of CAT.

The crux of the judgment of Ernakulam Bench of CAT upheld by Kerala High Court as well as by the Apex Court is as follows:

  1. Both M.O.Inasu and K.Ramachandran Unnithan are Pre-2006 Pensioners. They were Ex-Servicemen and thereafter Deputy Superintendent in Excise Department before retirement. Their combined services were less than 33 years of service and therefore they were granted only pro-rata pension and not full pension @ 50% of 10 months average pay.
  2. Both claimed for full pension @ 50% of their last pay drawn as recommended by the 6th CPC for employees with 20 years of qualifying service instead of 33 years.
  3. Tribunal initially considering as to whether the Pre-2006 Pensioners are eligible for 50% of the minimum pay in the relevant Pay Band plus GP even if they do not have put in 33 years of qualifying service came to the conclusion that they are not entitled to and dismissed the OAs as above.
  4. The Pre-2006 Pensioners appealed in Kerala High Court against the order of the CAT Ernakulam.
  5. Kerala High Court had set aside the order of the CAT Ernakulam Bench vide O.P.(CAT) Nos.898/2013 and 1409/2013 vide judgement dated 04.06.2013 and directed the CAT to re-hear the applications and consider entries at Sl. Nos. 2 and 12 of the Resolution No. 38/37/08-P&PW(A) dated 29.08.2008 of the Ministry of Finance.
  6. The Ernakulam Bench of CAT based on the observation made by the High Court thereafter had pointed out the para 4.2 of the OM dated 01.09.2008, that there is no  stipulation of any minimum period of service for eligibility of  pension @ 50% of the minimum of the pay in the Pay Band  plus Grade Pay of the post from which the pensioner had  retired. According to para 4.2, it is made clear that the pension should in no case shall be lower than 50% of the  minimum of the pay in the Pay Band plus Grade Pay  corresponding to the pre-revised pay scale from which the pensioner had retired. Therefore, denial of 50% f the pay  as basic pension is illegal and arbitrary.
  7. The Ernakulam Bench also pointed out the order of the Principal Bench of CAT Delhi that quashed the OM dated 03-10-2008 and 14-10-2008 and therefore the above two OMs are no more valid and no more in force. Therefore the decision of the CAT Delhi Principal Bench is also applicable to the applicants.
  8. The Bench also referred to the Principal Bench judgment and ruled that the benefit of 50% of minimum of pay in the pay band plus relevant Grade Pay shall be paid to the Petitioners even though they did not render 33 years of qualifying service.
The judicial verdict is another blow to the Government’s mis-interpretation on the following two counts:

  1. The minimum of Pay Band plus relevant GP instead of minimum of the pay in the Pay Band plus relevant Grade Pay of the Pre-2006 pensioners;
  2. 20 years Qualifying service instead of 33 years of qualifying service is applicable only for post-2006 retirees and not for Pre-2006 Pensioners.
In the background of this historic judgment all are requested to find out about such Pre-2006 pensioners who are denied full pension for not putting in 33 years service and make them represent for grant of full pension @ 50% of the minimum of pay in Pay Band plus Grade pay for the particular cadre in which they retired before 2006.

Chairman 7th CPC told earlier and the Finance Minister confirms it in Parliament now

7th Pay Commission recommendations likely this year : Finance Minister Jaitley at Lok Sabha


The recommendations of the 7th Pay Commission on pay revision of the central government employees is expected to be submitted to the government this year, the Lok Sabha was today informed.

Responding to a supplementary, Finance Minister Arun Jaitley said, ”Additional Tencent revenue share for the state being provided by the Centre from this year and the recommendations of the pay commission– that are expected to be made this year– are bound to put additional burden on the fiscal situation.”

“Keeping this in mind, we have opted to extend the deadline from two to three years for attaining the targeted mark of fiscal budgetary deficit,” he said.

Presently, the government’s annual income is around Rs 11.5 lakh crore against the expenditure of around Rs 17.5 lakh crore leaving a budgetary deficit of about Rs 5 lakh crore.

INORDINATE DELAY IN DR TO PENSIONERS CAUSING DISTRESS AMONG PENSIONERS

Dear Comrades - The Dearness Relief Orders by the Ministry of Pension & Pensioners Welfare is unduly delayed and we are concerned about it. Already a reminder Email has been sent to the Secretary Pension today by the CHQ. The General Secretary of AIPRPA is now in New Delhi in connection with the National Executive meeting of NCCPA and also the March to Parliament of Central Government Employees. If DR orders are not released by Monday morning, taking advantage of the presence in the capital, it has been proposed to visit the Ministry of Pension on Monday (27-04-2015)  with Comrade KKN Kutty the JCM Standing Committee Member and the President of Confederation of CG Employees to impress upon the authorities to release the orders without any more delay.

Sub: Continued delay in release of DR orders by the Ministry of Pension & Pensioners Welfare - requesting immediate action - regarding.

It is most unfortunate that the Ministry of Pension & Pensioners Welfare is yet to release the orders of enhancement of Dearness Relief to Pensioners in spite of the fact that the orders of the Finance Ministry had already been communicated to all Government departments and employees are drawing the increase of 6% DA. This Association is not able to understand the difficulties faced by the MOP&PW in releasing the orders as yet. This Association had earlier sent an email to the Deputy Secretary MOP&PW in this regard but there appears to be no progress in the matter. As of now no orders are released and the Pensioners are very restive all over the country. There should be a system to draw the periodical increase of DR to pensioners without delay as and when the Cabinet approves and the MOF issues necessary orders. This type of inordinate delay in release of orders to Pensioners is unjustified taking into account the delay causes mental agony to the senior citizens, whom are otherwise revered by the Government.

Hope this email would provoke immediate response and necessary action would be initiated to release the orders without any further delay.

AIPRPA GETS REGISTERED UNDER SOCIETIES ACT



AIPRPA CHQ's efforts to get the Association registered under the Societies Act has fructified and today the Association is registered. AIPRPA's registration number is 83/2015 and the Certificate of Registration is under print in the office of Registrar of Societies. The bylaw as approved by the Registrar of Societies as well as the Certificate of Registration will soon be exhibited here. Though the  process of registration was lengthy, the task was accomplished successfully at last. The Officials of Registrar of Societies and Comrade P.Mani the Tamilnadu State Assistant General Secretary who consistently followed up the case deserve the appreciation and thanks of our CHQ.

FORMATION OF AIPRPA IN SEVEN SISTERS' STATES

DISCUSSION FOR FORMATION OF AIPRPA IN NORTH EASTERN REGION



In the background of formation of Tripura State AIPRPA on 5th April, a discussion took place in Agarthala during the midst of the 34th Joint Circle Conference of NFPE Unions of Assam & NE Circles on the question of formation of AIPRPA. The discussion was organised by the RCC (Regional Coordination Committee) of Assam & NE Circle Unions. Circle Secretary P3 Assam Comrade L.P.Saikia informed that his circle conference has resolved to form AIPRPA in all Divisions of Assam Circle. The Circle Secretary P3 North East comrade Ramani Bhattacharya; Circle Secretary of P4 North East Comrade Smt.  Lakhamti Wahlang ; Circle Secretary of P4 Assam Circle Comrade Mainul Haque; Circle Secretary of R3 Assam Circle Comrade G.Talukdar; Circle Secretary of Postal Administrative Union of Assam Circle Comrade Pankaj Das; Regional Coordination Committee Secretary Comrade Debnath; Senior leader and former circle Secretary of R3 Assam Circle Comrade A.Rahman attended and participated in the discussion. 

Comrade M.Krishnan Secretary General Confederation & Ex-Secretary General NFPE and Comrade K.Ragavendran General Secretary AIPRPA & Ex-Secretary General NFPE were present and guided the meeting.  

Certain important decisions were taken for formation of AIPRPA in the entire region viz Assam, Meghalaya, Manipur, Arunachalpradesh, Mizoram and Nagaland States. All the Circle Unions and the RCC (Regional Coordination Committee) will take all necessary steps including discussing with the leadership of the existing Postal & RMS Pensioners Association in Guwahati for bringing all pensioners of postal and RMS within AIPRPA. 

Accordingly the joint subjects committee of the 34th joint circle conference of Assam & NE Circle NFPE Unions held on 8.4.2015 adopted a unanimous resolution on Policy & Programme. The above resolution stated that in line with the decision of the 9th Federal Council of NFPE held at Hyderabad action will be  undertaken to form AIPRPA in all divisions of 7 States in this North Eastern Region. 

AIPRPA CHQ Conveys its hearty thanks to the resolve of the NFPE Organisation led by RCC Assam & NE for the above soliarity.

Release of additional installment of Dearness Allowance to Central Government employees and Dearness Relief to Pensioners, due from 1.1.2015.


The Union Cabinet chaired by the Prime Minister, Shri Narendra Modi, today gave its approval to release an additional installment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners with effect from 01.01.2015 at the rate of six percent increase over the existing rate of 107 percent.


Hence, Central Government employees as well as pensioners are entitled for DA/DR at the rate of 113 percent of the basic pay with effect from 01.01.2015. The increase is in accordance with the accepted formula based on the recommendations of the 6th Central Pay Commission.


The combined impact on the exchequer on account of both DA and DR would be of the order of Rs. 6762.24 crore per annum and Rs. 7889.34 crore in the Financial Year 2015-16 (i.e. for a period of 14 months from January 2015 to February 2016).


This will benefit 48 lakh government employees and 55 lakh pensioners.

A Special Convention of Postal & RMS Pensioners was organised today at 4.00 P.M under the presidium of Comrades Indrajit Aine and M.Shome by the former All India Steering Committee Member Comrade T,Janardhan Debnath. 

The Convention was attended by many senior pensioners from Agarthala Division, Dharmanagar Division and R.K.Pur District. In accordance with the earlier directions, Comrade Debnath had taken measures to organise Divisional and District AIPRPA in the above three areas, which are already functioning as AIPRPA branches. 

This meeting was addressed by Comrades Sunil Das the Divisional Secretary of AIPRPA Agarthala, Comrade Janardhan Debnath former All India Steering Committee member, Comrade M.Shome and Comrade Indrajit Aine. The Circle President and Agarthala Divisional Secretary of AIPEU Group C Union Comrade Tapas Kumar Nath addressed the Convention and assured total support in building the AIPRPA in the State. 

General Secretary K.Ragavendran elaborately spoke on the needs of stronger organisation for the Postal & RMS Pensioners as well as the strengthening of Pensioners Movement against the currect dangers and attacks on social security and pension. 

The meeting has decided to organise a regular State Conference to democratically elect a State AIPRPA within three months. It was also decided that for facilitating maximum enrollment of pensioners as members as well as to organise the State Conference, a State Steering Committee should be necessary. Accordingly the Tripura State Steering Committee with the following Comrades were unanimously approved by the Special Convention.

Maharashtra gearing up for building AIPRPA

MUMBAI AIPRPA REGULAR FORMATION UNDER CONSULTATION

A meeting of important office bearers of AIPRPA State Steering committee of Maharashtra along with the leaders of NFPE P3 and P4 leadership was held at Dadar HPO on 29.03.2015. The meeting was presided over by the State President AIPRPA Comrade Pande and the CHQ President Comrade D.K.Rahate and General Secretary Comrade K.Ragavendran participated. 

Comrade Mangesh Parab the Circle Secretary P3 Maharashtra (as well as the Working President of P3 CHQ) and Comrade Surve the JCM Departmental Council Member of P4 CHQ attended and addressed the meeting and assured total cooperation in building the AIPRPA in Maharashtra State. 

The meeting was addressed by the General Secretary on all the developments relating to Pay Commission and Pensioners issues. The meeting decided that the Circle Secretaries of NFPE Unions along with the AIPRPA State leadership will issue a joint circular to all divisions and branches regarding guidelines for building the AIPRPA in all areas. It was decided to organise Region Wise meetings in the headquarters of all the Postal Regions inviting all former divisional secretaries of postal service unions to facilitate formation of AIPRPA.
